Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Kweki website and mobile application (the "Platform"), operated by NS MOZA (SARL), a limited liability company registered in Tunisia (Tax ID: 1712424P), registered office at Rue Moustapha Khaznadar, 8080 Menzel Temime, Tunisia. By creating an account or using the Platform, you agree to be bound by these Terms.

Description of the Platform

Kweki is a mobile-first live shopping marketplace connecting sellers (merchants and small businesses) and buyers across Tunisia through live-streamed sales sessions. Kweki acts as an intermediary platform and is not itself the seller of products listed by third-party merchants, unless explicitly stated otherwise.

Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must be at least 18 years old, or have the consent of a legal guardian, to create an account.
• Kweki may suspend or terminate accounts that violate these Terms.

Sellers on the Platform

• Sellers are responsible for the accuracy of their product listings, pricing, stock availability, and product quality.
• Sellers must comply with all applicable Tunisian consumer protection, commercial, and tax laws.
• Kweki may set commission fees, review products, and remove listings that violate these Terms or applicable law.

Orders and Payments

• Orders placed through the Platform may be paid via cash on delivery (COD) or via in-app payment through Flouci.
• When paying via Flouci, payment is processed securely through Flouci's payment infrastructure at checkout or order confirmation.
• Prices displayed on the Platform are in Tunisian Dinar (TND) unless stated otherwise, and are inclusive of applicable taxes unless stated otherwise.
• Kweki reserves the right to cancel orders in cases of suspected fraud, pricing errors, or unavailability of stock.

Delivery

• Delivery is carried out either by Kweki's own delivery service or by third-party delivery partners.
• Estimated delivery times (including same-day or next-day delivery where available) are indicative and not guaranteed.
• Risk of loss and title for products pass to the buyer upon delivery.

Live Shopping Sessions

• Live sessions are hosted by sellers to showcase and sell products in real time.
• Kweki is not responsible for statements made by sellers during live sessions but may moderate content that violates these Terms.
• Users must behave respectfully in live chat and are prohibited from harassment, spam, or fraudulent behavior.

Returns and Refunds

• Return and refund conditions depend on the specific seller's policy, displayed on the relevant product or order page, and applicable Tunisian consumer protection law.
• Refunds for payments made via Flouci will be processed back through the original payment method where applicable.

Prohibited Uses

You agree not to:

• Use the Platform for any unlawful purpose
• List or sell counterfeit, illegal, or prohibited goods
• Attempt to circumvent platform fees or payment systems
• Interfere with the security or proper functioning of the Platform

Intellectual Property

All intellectual property rights in the Platform, including the Kweki name, logo, and software, belong to NS MOZA (SARL). Sellers retain ownership of the content and images they upload but grant Kweki a license to display this content on the Platform.

Limitation of Liability

To the maximum extent permitted by Tunisian law, NS MOZA (SARL) shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to disputes between buyers and sellers, delays in delivery, or product quality issues, except where such liability cannot be excluded by law.

Termination

Kweki may suspend or terminate your access to the Platform at any time, with or without notice, in case of violation of these Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of Tunisia. Any dispute arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of Tunisia.

Changes to These Terms

Kweki may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
